Scope of Practice in Family Matters

I have repeatedly assisted clients in a variety of family and guardianship law cases at all levels of jurisdiction and across Poland. Through my experience, I understand the expectations of judges adjudicating in Family and Juvenile Divisions, which enables me to prepare appropriately for each case. My practice includes in particular:

  • divorce proceedings (both uncontested and contested);
  • maintenance (alimony) cases (establishment, increase, reduction, and declaration of expiry), both for minor children and other family members;
  • cases concerning contact arrangements or modification of contact arrangements;
  • division of marital property;
  • proceedings concerning parental authority and the place of residence of minor children;
  • proceedings concerning court supervision over the exercise of parental authority;
  • guardianship proceedings and cases involving juveniles.

Mediation vs Court Proceedings

In every family case, I seek to propose the least burdensome method of resolving the dispute for the client. Where possible — mediation and amicable settlement. Where necessary — full and efficient court proceedings.

Frequently asked questions

What is a prenuptial agreement?

A prenuptial agreement is a term most commonly used for a contract establishing separation of property between spouses. Concluding such a contract means that joint marital property either ceases to exist or never arises. As a result, each spouse remains the owner of everything they acquire during the marriage.

How to resolve property matters during a divorce?

This question is based on an incorrect assumption – although it is theoretically possible, in practice it is very rare for a court to divide marital property during divorce proceedings. Importantly, property matters can be resolved independently of the divorce, in separate proceedings or even before a notary. Combining divorce and property division is usually not recommended, as it further complicates an already complex situation.

What child support am I entitled to for my child/children?

According to applicable regulations, the amount of child support depends on two factors. The first is the justified needs of the minor – a child has the right to live at the same standard as their parents (the principle of equal living standards). The child’s expectations correspond to the standard of living of the parent obligated to pay. Special needs (educational, medical, etc.) are also taken into account. The second factor is the financial situation and earning capacity of the obligated person – meaning how much they earn or could earn.

What is the difference between parental authority and contact rights?

The key point is that parental authority does not include the right to contact. A parent who has been deprived of parental authority still has the right to contact with the child, and conversely, failure to exercise contact does not mean loss of parental authority. Parental authority (custody) primarily means the right to make decisions on behalf of the child and about the child (education, medical treatment, foreign travel, etc.), manage the child’s property and provide care. Contact refers only to spending time together.
